What ZenStream Is For?

ZenStream is for businesses who want to live stream videos on the internet to their clients, prospects and subscribers. ZenStream is currently providing a server to player live streaming solution with API integration for website and app. ZenStream in future may look to provide more technology solutions to you as they come up.

Your Live Stream Video

You made your video, so you retain all of your ownership rights in your content. ZenStream will never share your account videos with any third party.

You are solely responsible for your own content and the consequences of posting or publishing it. ZenStream expressly disclaims any and all liability in connection with your content.

What we do not want you to do?

We don't want you using ZenStream to upload content that:

• a) Violates Indian law or the law of the jurisdiction under which you operate;

• b) Infringes any third party's copyrights or other rights (e.g., trademark, privacy rights, etc.);

• c) Contains nudity, pornography, sexually abusive content, exploits minors; depicts unlawful acts or extreme violence;

• d) Contains hateful, defamatory, or discriminatory content or incites hatred against any individual or group;

• e) Depicts animal cruelty or extreme violence towards animals;

• f) Creating multiple free trial accounts by single user/business is strictly prohibited and will lead to closure of all such accounts;

If you do upload a video that is unsuitable we reserve the right to remove that video. In extreme cases or, for persistent infringing behavior, we may suspend your account and prohibit further use of the ZenStream service. We'll contact you directly and explain any action we take. No failure or delay by ZenStream in exercising any of our rights in this Agreement will waive any further exercise of that right.

Procedure for Reporting Copyright Infringement

ZenStream does not own the rights to content hosted through it. All the content ownership lies with the video uploading subscriber. If You believe that Content residing accessible through the ZenStream Services infringes a copyright, please send a notice of copyright infringement containing the following information to the support mail listed below:

• 1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed;

• 2. Identification of works or materials being infringed;

• 3. Identification of the Content that is claimed to be infringing including information regarding the location of the Content that the copyright owner seeks to have removed, with sufficient detail so that ZenStream is capable of finding and verifying its existence;

• 4. Contact information about the notifier including address, telephone number and, if available, e-mail address;

• 5. A statement that the notifier has a good faith belief that the Content is not authorized by the copyright owner, its agent, or the law; and

• 6. A statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the copyright owner.

Action upon Proper Bona Fide Infringement Notification Received by the Designated Person

It is ZenStream’s policy:

• 1. to remove or disable access to the infringing Content;

• 2. to notify the Content provider or user that it has removed or disabled access to the Content; and

• 3. that repeat offenders will have the infringing Content removed from the system and that ZenStream will terminate such content provider’s or user’s access to the Services.

Procedure for Reporting & Removing Malicious Content

ZenStream does not own the rights to content hosted through it. All the content ownership lies with the video uploading subscriber. We regularly check for any malicious content being uploaded to us and remove it immediately with a notification to the account holder. If You believe that content accessible through the ZenStream services violates the Indian or your country laws, please send a notice containing the links to content & nature of violation to the support mail listed below.

Action upon Malicious Content Notification Received by the Designated Person

Based upon details received and case specific discretion, ZenStream will look to:

• 1. to remove or disable access to the malicious content,

• 2. to notify the Content provider or user that it has removed or disabled access to the Content, and

• 3. that repeat offenders will have the content removed from the system and that ZenStream will terminate such content provider’s or user’s access to the Services.

Pricing

Our plans have bandwidth and storage limits. We reserve the right to limit subscribers who are exceeding their account bandwidth limits.

It is your responsibility to track the usage of your account and act accordingly. Subscribers will be emailed when their allowance reaches 80% and 100% of their plan limit. You can track your usage at any time by logging in to the account usage page. Subscribers who exceed 100% of their allocated allowance will be emailed with notification of how to upgrade to an appropriate plan. Continuing infringement of this allowance will result in the video content being replaced with a upgrade message.

Privacy

On signing up we request your name and email ID. Your email ID will be our point of contact with you, and your source of authentication with your ZenStream account.We use web analytics tools that provide anonymized aggregated data about our users' experience of our website. This helps us understand how much time users spend on our website, what links they choose to click, and which content on our website users find most useful. Using this information we are able to present you with the best content possible.

• We don't want to misuse your data. (such as email address, name, address etc.).
• We won't ever sell your personal information to anyone else.
• We won't spam you (but we will send you useful updates and news from ZenStream).
• We won't divulge your information to anyone you haven't asked us explicitly to reveal it to.

In compliance with EU's General Data Protection Regulation, we would be happy to delete all user identifiable data on request. We also extend this facility to our users outside of EU.

What we will do with your data?

• Aggregate anonymous information about how you use ZenStream.
• Gather information about how you view videos and account to see what's popular.
• Gather information on how videos are viewed so we can make sure our platform runs smoothly for you.
• Delete all user identifiable data on request.

A Note on Cookies

ZenStream places cookies, which are small data files, on your computer or handheld device. The use of cookies is standard for all websites. Cookies allow us to collect information about browsing and buying behavior, and are essential for providing a high quality website experience to you.

By using the zenstream.live website, you consent to cookies being used. If you do not consent, please disable cookies in your browser settings.

How we shall communicate with you?

We have requested your email address so that, if we need to, we can get in touch with you regarding your account. By signing up you are giving us permission to email you updates on the ZenStream service and to contact you individually should the need arise.

You consent to receive all communications including notices, agreements, disclosures, or other information from ZenStream electronically. If you wish to unsubscribe, please drop a mail at support@zenstream.live

Refunds and Cancellations

You are free to cancel or downgrade your paid plan at any time. We will not refund subscriptions that have already been paid. There is a free trial for 30 days to best gauge ZenStream offerings. Only for the cases where your ZenStream account is inaccessible for 72 continuous hours, or ZenStream playback is down for 72 continuous hours, you can seek to get a refund. In all other cases, there will be no refund of money.

ZenStream can only look to provide extra bandwidth credits in lieu of any fault in services during the course of your paid plan.

Deleting your Account and Videos

You can request us to delete your account and all your videos at any time via a mail at support@zenstream.live. We'll delete your account within 7 days.

Indemnification

You indemnify, defend, and hold harmless ZenStream and its directors and employees, from and against all third party actions that: (i) arise from your content on the ZenStream platform (ii) assert a violation by you of any term of this Agreement; or (iii) assert that any content you hosted on the ZenStream platform violates any law or infringes any third party right, including any intellectual property or privacy right.

Governing law

The laws of India shall govern this Agreement and its performance. You consent and submit to the jurisdiction of the courts located at New Delhi, India, in all questions and controversies arising out of this Agreement and your use of ZenStream.
